The public hearing was called to order by Mayor Stoner on Thursday, December 3, 2009 at 7:07 p.m. in the Council Chambers of the Northwood Municipal Building.

Roll Call:
|
The roll was called by the Clerk of Council and those in attendance were: Mayor Stoner; Council members Kozina, Edwards, Myers, Barton, Gallaher and Schimmel; City Attorney Ballenger, City Administrator Bacon and Clerk of Council Goertz.
Note: Councilwoman Hughes, Councilman Gallaher and City Engineer Kuhn were absent.
Note: Councilman Gallaher arrived to the public hearing at approximately 7:10 p.m. (after roll call)

Purpose of Public Hearing:
|
Mayor Stoner stated that the purpose for the scheduled and advertised public hearing was for City Council to review and to receive public comment regarding a zoning appeals application submitted by appellant, Mr. Keith Heyman of 4422 Curtice Rd., Northwood, Ohio. Note: A copy of the public hearing agenda with additional information pertaining to the zoning appeals case (Case No. 0518) is attached to these original proceedings on file with the Clerk of Council/City Clerk.

|
Councilman Schimmel stated he did not believe that Mr. Heyman’s business could be considered as seasonal since he was requesting a variance to allow for a business sign to be installed on his property for a period of six months.

Attorney:
|
City Attorney Ballenger stated that he was not sure that Mr. Heyman’s boiler sales business could be considered a home occupation; normally a home occupation is a business such as someone who is a seamstress or an accountant working out of their home.

A motion and second were made by Council members Myers and Edwards to excuse Councilwoman Hughes from the regular Council meeting of December 3, 2009. Council vote: All present in favor. Motion passed.

A motion and second were made by Council members Edwards and Kozina to approve the minutes from the regular Council meeting held on November 19, 2009, as submitted. Council vote: All in favor. Motion passed.

|
Councilman Barton reported on the Service meeting of 12/3/09:
1. Standing water in driveway at 4023 Wise St. – Additional information reviewed on this pending item. The Public Service Director will be checking this driveway and others in the area and this matter will remain a pending Service committee item.

2. HVAC quotations for 2010: New bids will be requested and available for review at the next regular Council meeting on December 10, 2009.

3. Robert Hirzel family request for naming of private lane on property in Rossford/Northwood. The Planning & Zoning Coordinator is authorized to approve the family placing a lane name sign; however; this private lane will not be treated considered or serviced as a public roadway or drive.

4. Red Light Photo Enforcement sign needs replaced at the intersection of Fostoria Road and State Rte. 579. The sign which had been installed under the Welcome to City of Northwood sign is missing.

|
Ordinance 2009-34 authorizing the City Administrator to enter into a contract with Medical Mutual of Ohio, Inc. for Non-Union Employee Health Insurance and Prescription Coverage, and declaring an emergency.

|
Prior to motions of Council, City Administrator Bacon advised of an amendment needed to Section 1. to state “and shall include all union employees who voluntarily participate.”
A motion and second were made by Council members Kozina and Edwards to adopt the emergency clause for Ordinance 2009-34. Council vote: All in favor. Motion passed.

Chief Romstadt has reported that the following individuals have resigned from the Fire Department (District No. 1):
- Orlando Cuevas has submitted his resignation with an effective date of November 13, 2009. Orlando has resigned after three years of service.
- Dustin Sosko has also resigned with an effective date of November 12, 2009.

Annexation of Property – Lemoyne Road: City Attorney Ballenger reported he would be preparing a draft resolution for Council’s consideration at the next regular Council meeting on December 10, 2009.

- ODOT has made some changes to the Bradner Rd./Curtice Rd. intersection improvements project
